Photography Terms & Conditions

Agreement: These Terms & Conditions constitute the entire agreement between Derek Austin Photography and the Client. Any changes must be made in writing and agreed to by both parties.

Payment: Package pricing is locked in at the time of booking. Full payment is due upon booking unless otherwise agreed. All payments are non-refundable, as your session date and time are reserved exclusively for you.

Rescheduling & Weather: Session rescheduling is subject to the Photographer's availability. If a new date cannot be arranged, the Client will receive a credit toward a future session. If severe weather prevents an outdoor session, the Photographer will reschedule or issue a session credit if a new date cannot be agreed upon.

Session Policies: Personal cameras or recording devices are not permitted during the session. The Photographer reserves the right to determine the artistic style, editing, composition, and final selection of images.

Client Responsibilities: The Client and all participants are expected to cooperate throughout the session. The Photographer is not responsible for missed images due to lack of cooperation, late arrivals, or absent participants. The Photographer may end the session without refund if threatened or if unsafe conditions exist. The Client is responsible for any damage caused to the Photographer's equipment or property and assumes responsibility for all participants' conduct.

Copyright & Image Use: Derek Austin Photography retains full copyright to all images. Clients may use their images for personal purposes but may not sell, edit, apply filters, or alter them. Images may be shared on social media provided Derek Austin Photography is credited. Commercial use requires prior approval and appropriate credit.

Photographer Rights: The Photographer may use images for portfolio, marketing, competitions, editorial, and promotional purposes. If necessary due to illness or emergency, the Photographer may provide a qualified substitute photographer.

Liability: If the Photographer is unable to perform due to illness, emergency, severe weather, or circumstances beyond their control, liability is limited to a refund or session credit, as applicable. The Photographer is not liable for losses resulting from equipment failure, file corruption, or other unforeseen events beyond their control. Liability shall never exceed the amount paid by the Client.

Image Delivery: Edited digital images are typically delivered within 4–6 weeks, though delivery times may vary during peak seasons.

General: If any provision of this agreement is found unenforceable, the remainder shall remain in effect. This agreement is governed by the laws of the State of Ohio.

Acceptance: By submitting a booking inquiry or completing a reservation, the Client acknowledges that they have read and agree to these Terms & Conditions.
